Vice President Joe Biden and Secretary of Education Arne Duncan announced new guidance for colleges and universities in their obligations to prevent and respond to campus sexual assault on Monday at the University of New Hampshire in Durham. The guidance clarifies the legal obligations under Title IX that universities and colleges receiving federal funds have in their response to campus sexual assault. The guidance included practical examples to help educators.
As reported by the Department of Education, New York University’s main campus had 3 instances of forcible sexual assault in both 2008 and 2009, with no instances in 2007. There were no reported instances of non-forcible sexual assault at the same campus for any of those years.
Because Title IX prohibits discrimination based on one’s sex, sexual violence (such as rape, sexual assault, battery and coercion) is also considered discrimination.
